These Terms of Service ("Terms") govern your access to and use of the Shafrah AI WhatsApp assistant and related services (the "Service") provided by Shafrah ("Shafrah", "we", "us"). By using the Service you agree to these Terms.
The service
Shafrah AI is a multi-tenant software service that lets businesses connect their WhatsApp number to an AI assistant that replies to customers, transcribes voice notes, and helps schedule meetings.
Eligibility and accounts
You must be able to form a binding contract to use the Service. If you use the Service on behalf of a business, you confirm that you are authorized to bind that business to these Terms. You are responsible for keeping your account credentials secure and for activity under your account.
Acceptable use
You agree not to use the Service to:
- Break any applicable law or regulation, or infringe the rights of others.
- Send spam or deceptive, fraudulent, or unsolicited bulk messages.
- Upload malware or attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
- Process data you have no lawful right to process, or violate WhatsApp / Meta policies and terms.
- Send unlawful, harmful, harassing, or otherwise objectionable content.
Customer data and your responsibilities
You are responsible for the content and data you and your customers submit through the Service, and for obtaining any consents required to message your customers on WhatsApp. Our handling of personal data is described in our Privacy Policy.
Third-party services
The Service relies on third parties including Meta / WhatsApp, OpenAI, OpenRouter, and ElevenLabs. Their availability and terms are outside our control, and your use of WhatsApp is also subject to Meta's terms.
Fees
Paid plans, where applicable, are billed as described at the time of purchase. Fees are non-refundable except where required by law.
Intellectual property
Shafrah retains all rights to the Service, its software, and brand. You retain rights to your own content. You may not copy, resell, or create derivative works from the Service without our written permission.
Service availability
We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time.
Disclaimer ("as is")
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. AI-generated replies may be inaccurate, and you are responsible for reviewing automated communications with your customers.
Limitation of liability
To the maximum extent permitted by law, Shafrah will not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months before the claim.
Indemnity
You agree to indemnify Shafrah against claims arising from your misuse of the Service or your breach of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. On termination, we will delete or return your data as described in our Privacy Policy.
Changes to these terms
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Qatar, and any disputes are subject to the courts of Qatar.
